We meticulously adhere to intellectual property laws and industry best practices. This Intellectual Property Policy delineates our approach to handling allegations of infringement, the procedure for authorized parties to report infringements related to content on our platform, and guidelines.

1. Keral's Role While Keral provides the platform, it does not engage in the production of goods. Content uploaded on Keral's marketplace is created by independent sellers ro third party programs who are not considered employees, agents, or representatives of Keral. Sellers are obligated to ensure they possess all necessary rights to their content and avoid any infringement of third-party rights.

Keral reserves the right to disable any listing, shop, or account that violates our Terms of Use, including this Intellectual Property Policy or our Prohibited Items Policy. Actions may be taken against those who misuse Keral's Intellectual Property Policy or our Terms of Use.A

Keral cannot advocate for intellectual property owners or provide legal advice. The platform does not have the authority to make legal determinations regarding whether a shop’s content infringes on someone else’s intellectual property. Keral will promptly remove material cited for alleged intellectual property infringement upon receiving a report that aligns with our policies.

2. Reports of Intellectual Property Infringement Keral is committed to swift responses upon receiving reports of intellectual property infringement that comply with our policies. We aim to remove or disable access to allegedly infringing material and make reasonable efforts to inform the affected member about the report and removal. In cases of alleged copyright infringement, information on how to submit a counter notice may be provided. Keral may also share a copy of the infringement report, including the reporting party’s name and email address, with the affected member.

Keral may request additional information before processing a report, such as a letter of authorization from the rights owner or identity verification of the reporting party. Reports or counter notices containing false, fraudulent, incomplete, or bad faith information may be rejected. Keral also reserves the right to take action against policy abusers.

3. Counter Notice Keral accepts counter notices for US-based copyright infringement reports under the Digital Millennium Copyright Act (DMCA). Upon receiving a DMCA counter notice, Keral provides a copy to the original complaining party. The removed material may be reinstated or access restored 10 business days after processing the counter notice, unless the copyright owner files an action seeking a court order or qualifies for action with the Copyright Claims Board (CCB).

4. Repeat Infringement In instances of repeat or multiple notices of intellectual property infringement, Keral reserves the right, at its discretion, to terminate the selling privileges of the involved members or promote the product from a specific third-party partner store.. If it is believed that a member has attempted to open a new shop following the termination of their initial account, Keral retains the right to refuse all services to that member. These actions are applicable to any accounts deemed associated with or operated by the affected member. As outlined in our Terms of Use, Keral maintains the authority to terminate account privileges at any time, for any reason, and without advance notice.

5. Withdrawals Keral exclusively accepts withdrawals of infringement reports directly from the intellectual property owner or the authorized representative who submitted the claim. The withdrawal must explicitly state that it is a formal withdrawal and provide sufficient identification of the member and/or material (including the username, shop name, product and Keral listing URLs).

Upon receipt of a formal withdrawal of an infringement report, Keral will promptly reach out to the withdrawing party to confirm receipt and will notify the affected member of the withdrawal. It is important to note that infringement matters are meticulously reviewed on a case-by-case basis, and withdrawals do not guarantee changes to a member's shop status.
